Compliance Update

HIPAA Audits will begin targeting “downstream providers”. ARRA 2009 expanded HIPAA’s reach further down the contract chain from payors, hospitals and doctors to include those entities providing goods and services to the “covered entities.” The vast majority of physicians and payors lack complete and accurate risk assessments.

Two recent cases resulted in fines of $5.5 million to the covered entities because they did not have appropriate documentation with their business associates. One of the cases involved a stolen laptop from Feinstein Institute for Medical Research, a branch of North Shore Long Island Jewish Health System. The second case involved a billing company (Accretive Health) having access into a hospital’s (North Memorial Health Care) data bases without the presence of a BAA, risk assessment, risk action plan, etc.

Bottom line: You must have a BAA with your vendors if they have access to PHI in your possession; you must have a risk management plan and you must do a risk assessment.
